Chapter 7 Bankruptcy Overview

One option for people with serious financial troubles is to file for bankruptcy protection under Chapter 7 of the United States Bankruptcy Code. Chapter 7 bankruptcy allows you to discharge certain eligible debts, including:

  • Credit card debt
  • Personal loans (unsecured loans)
  • Medical bills
  • Default fees or interest
  • Other personal debt

Please note, some debts are not eligible for discharge through bankruptcy, including back taxes, child support obligations and school loans.

Chapter 7 bankruptcy is also known as liquidation bankruptcy because some of the debtor's property is sold and the proceeds used to pay creditors. Typically, the remaining eligible debts are forgiven. Please note, there are federal exemptions that allow debtors to keep their home, automobile and furnishings. Attorney Goldfarb will fully explain these exemptions and the property you would be able to keep.

Not everyone is eligible for Chapter 7 bankruptcy and attorney Stephen Goldfarb will help you determine your eligibility using the applicable means test. People who are not eligible for Chapter 7 bankruptcy, however, are generally eligible for Chapter 13 bankruptcy.
